The FMLA tests in plain English
To qualify under the federal Family and Medical Leave Act you generally need to: (1) have worked for your employer for at least 12 months, (2) have worked at least 1,250 hours in the 12 months before leave starts, and (3) work where the employer has 50 or more employees within 75 miles. Public agencies and schools are covered regardless of size.
The 12 months do not have to be consecutive, but some older work periods may not count. Your employer may also be covered by a state leave law with different rules. This is a quick screening tool, not a legal determination.
