How overtime pay works
Under the federal Fair Labor Standards Act (FLSA), most non-exempt employees must be paid at least 1.5 times their regular rate for hours over 40 in a workweek. Some states, such as California, also require overtime after 8 hours in a day or double time at certain points, so check your state's rules. Salaried employees can still be eligible for overtime unless they meet the exemption tests for duties and salary level.
The "regular rate" can include more than base pay, for example non-discretionary bonuses and shift differentials. This calculator uses the hourly rate you enter.
